Nintendo has always been super sensitive about their material, I don't know why.
I think the reason most Japanese companies don't pursue litigation against doujinshis is due to the fact that, a lot of times, it drums up interest in their franchises. The little meager pittance doujinshi artists make selling their work at conventions doesn't cut into the profits of the actual series and companies themselves to warrant pursuing legal action against them. Toyble, I believe, was able to start selling his online due to a minor release and liability form he got from Viz and Toei (for those who don't know, its highly rumored that Toyble was an animation artist for Dragon Ball Z and GT), but that's merely speculation at this point. But I mean, look what it did for him. He's been doing the Victory Mission manga for a while now, so his doujinshi actually got him somewhere. Maybe US Companies should take the hint...
