Daizex YouTube account suspended?
I went to go check a few old commercials you guys had posted up there and it said your account got suspended. I doubt you care since it's well YouTube, but still found it regardless.
If this doesn't go here then my bad. But, it seems like it's website discussion. Sorry, if it's old news too...

Yeah, Mike commented on such on his Twitter. It sucks quite a bit. Maybe he can throw the commericlas and stuff up for download?

I suppose, I was just looking for them for entertainment, nothing serious. But, still sucks the account is down. I know the feeling though, on No. 3. Wait, YBM aren't you on like account 8? You know, I think I remember Mr. EX saying something about reporting it if his account got suspended after Team Four Star's was. Is he still planning on doing that, or would it not do any good?

But in response to your blog, hmm... I know it's not me who would have to do the work, but I can't help but feel you should fight it. Like you said, while the DMCA protects copyrighted works, it can (and does) serve as a legitimate hurdle to free speech, and it's a bit creepy that they can just come along and do something like that. Corporations looking to silence people depend on the apathy of the general public.

I just ended up deleting almost every video I have due to YouTube and third party companies being so strict these days. I already has one account disabled and I don't want that happening again.

Nowadays, everybody is afraid of uploading a video they've put their effort in making it as good as possible on Youtube, only to end up taking it down or their whole channel because of ((the usually false)) DMCA claims.
This is why BigAl2k6 has moved to http://www.blip.tv and left his constantly deleted youtube accounts.
If they don't want their materials to be broadcasted on Youtube, why not taking down everything available instead of what I like to call "Dart-board System". Or better yet, shut down the whole site and nobody will watch illegally uploaded videos anymore! You find videos with a certain type of content deleted, and others remain as they are! Why?! I don't know.
In my Youtube account, I have three Dragon ball-related videos. My Zeyad Errafae'ie tribute ((12,728 views BTW)) video received this "Copyright Info":
The video is still available... The broadcast is labeled as "Matched third party content.". Why do I get a copyright info from FUNimation about a video that is not from their dub?! I'm not even from America for crying out loud! I have no idea why. It doesn't even look like a warning to me.
Another one is a lame-assed poor attempt of an AMV, but it received no notices, no copyright info, nothing.
The third one is a clip show about the Arabic dub voices and I made it private to avoid any "potential" trouble. I had more videos in the past, but I deleted them all not noticing the ability to make them private. Most of them are in my Metacafe account.

Youtube has gone downhill with everything gets deleted in the name of "Copyright Infringements" and the "DMCA". People can't even do video reviews of anything without a getting a DMCA claim unless they are a big-named website. Nobody can share his thoughts or opinions in video format anymore the same way is used to be in the past!
The only way left to stay on Youtube is by doing stupid, meaningless things full of crappy retarded contents. Because that's what they like, as seen on the front page and the Videos Being Watched Now page.
There is no place left for any intelligent people on that site. End of story.

There's no difference, they just haven't gotten to those videos yet. They can't pull what isn't reported. Once the other videos are noticed and reported they'll be removed as well. It's like asking why one bank robber got arrested when the other didn't. Also, the different response to content are not YouTube's doing. Things like muting audio, removing the video, blocking it in certain locations, etc. That's all determined by the copyright owner. WMG and Sony Music, for instance, will have ads placed on the video page, linking to places you can buy the song, if there's an audio content match. Some others will have audio muted preferring not to let it be heard for free.
Some video content owners will allow clips without issue, some will have their distribution limited so as not to step on other copyright toes, others will have them pulled completely not wanting any free distribution of their content, even in a limited fashion. I've not yet seen any video content matches that have ads for purchasing of the product, but I wouldn't be surprised if those exist as well. (In fact, that's probably what keeps FUNi content matches on YT, like the one SilverPlaque mentioned.)
A Fair Use disclaimer is not 'get out of jail free card' for posting whatever you want. If it's legitimate Fair Use (such as the inconsistency videos DaizEX had up) then it might have an effect. But just throwing it up on random videos that do not fall under Fair Use wont work (such as random clips of shows and such).Silver Sinspawn wrote:You can override copyright with a legal passage. And putting up a "such-and-such is the copyright of so-and-so and no infringement was intended, nor do I claim this as my own work, yada-yada" disclaimer? Utter waste of time. They do absolutely nothing except make you feel better. It's like those old disclaimers you'd find on ROM sites that said you could legally download things you didn't own so long as you deleted them in 24 hours. Or the current ones that say you can legally download games you do own. You can't, in either case. Both instances are still considered theft because even in the latter the ROM or ISO you are downloading did not come from the product you have.
And even if it did, that's still a gray area, because companies claim making digital copies of their stuff is a breech of copyright while it could technically fall under Fair Use and, as far as I can remember, no official court ruling has yet settled the matter.
