Question about scanslations

Post by Adamant » Mon May 17, 2004 4:03 am

(Yeah, I know, it's not really DB related.)

*Toriyama's World has scanslated Toriyma's manga "Kajika".
*This manga has been released in Denmark.
*Is it legal for me, a norwegian, to:
a) download the scans?
b) post a link to Toriyama's World on a public, norwegian message board.

If you country is under the Berne Convention, which I'm sure it is, then it's not legal considering-

1. any manga officially done/published is still copyrighted
2. the translation isn't official

therefore both are in breach of copyright terms and junk. However, best to contact the owner of the said message board just in case.

Well, US is on that list as well, and as far as I know, scanslations of manga not availiable in english aren't illegal there.

I wouldn't be so sure that they aren't illeagal, just that nobody cares/has the means to convienently enforce their ownership.

Copyright is infringed indirectly:

by any person who, without the authority of the copyright owner, imports, sells, lets, by way of trade offers or exposes for sale or hire, or distributes for purposes of trade
IE: Unless you're scanslating for yourself, they're illegal. Any scanslation is, it's just that nobody wants to admit it.
